Terms of Service

These Terms of Service (“Terms”) govern your access to and use of gem4art.comand any purchases you make through it, operated by Frame Design GEM Gallery (“we,” “us,” or “our”). By using the Site or placing an order you agree to these Terms. If you do not agree, do not use the Site.

Eligibility

You must be at least 18 years old and able to form a binding contract to place an order.

Products, descriptions, and pricing

• Many pieces are one-of-a-kind. Once sold, a piece is no longer available even if it remains visible on the Site for reference.
• We work to display artwork, materials, and colors accurately, but we cannot guarantee that your screen renders them exactly. Slight variations are inherent to original art and framing materials.
• Prices are in U.S. dollars and may change without notice. We may correct pricing or description errors and cancel any affected order, even after it is placed.
• All orders are offers to purchase and are subject to our acceptance. We may refuse or cancel an order for any lawful reason, including suspected fraud or errors.

Payment

Payments are processed by Stripe. You authorize us, through Stripe, to charge your payment method for the total shown at checkout, including any shipping fee and applicable taxes.

Sales tax

Applicable California sales tax is added where required. You are responsible for any other taxes or duties imposed by your jurisdiction.

Fulfillment: pickup and shipping

• Local pickup is available at our Los Angeles location by the date and time window you select at checkout. Please bring your order confirmation. Uncollected pickup orders may be handled as described in our Refund / Return Policy.
• Shipping is offered within the United States for a flat fee shown at checkout. Title and risk of loss pass to you upon delivery to the carrier for shipped orders, and upon collection for pickup orders.
• Delivery timeframes are estimates, not guarantees.

Custom framing

Custom-sized and made-to-order framing is produced specifically for you based on the details you provide. It is final sale and cannot be canceled once production has begun. Please review your specifications carefully before ordering.

Returns and refunds

Purchases are subject to our Refund / Return Policy, which is incorporated into these Terms.

Intellectual property

All content on the Site — text, images, layout, and branding — is owned by us or our licensors and is protected by intellectual-property laws. Copyright in individual artworks remains with the respective artists. Purchasing a piece transfers ownership of the physical object only; it does not transfer copyright or any reproduction rights. You may not reproduce, distribute, or create derivative works from Site content without written permission.

Acceptable use

You agree not to misuse the Site, including by attempting to breach security, submitting false information, scraping at scale, introducing malicious code, or interfering with other users.

Disclaimers

The Site and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to the Site or your purchase. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Indemnification

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Site or violation of these Terms.

Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

Changes

We may update these Terms from time to time. Changes take effect when posted, indicated by the “Last updated” date above. Your continued use of the Site means you accept the revised Terms.

Severability and entire agreement

If any provision of these Terms is held unenforceable, the rest remain in effect. These Terms, together with the Privacy Policy and Refund / Return Policy, are the entire agreement between you and us regarding the Site.
